Google Threatens Foxtel Over TV Guide Android App To Be Stripped From Store

EXCLUSIVE: Google is set to pull down the Android Apps of Australian TV Companies such as Foxtel and Ice TV after US Company TV Guide, laid claim to the name ‘TV Guide’ and the layout that delivers information about Australian TV programs. Lawyers for TV Guide, which is now owned by Lions Gate Entertainment are known for the “bullyboy” tacts claims local TV Guide Company Ice TV and Foxtel is in breach of TV Guide patents because they use the words ‘TV Guide’.

A letter obtained by SmartHouse, that was sent by Ethan Tyer Vice President of Business and Legal Affairs at TV Guide in the USA to Foxtel and Ice TV claims that both Companies are deceiving consumers as to the origin and sponsorship of Foxtel’s TV program listing service used in the Android application which is available to be downloaded to Tablets and Smartphones.

Lawyers for TV Guide claim that both Foxtel and Ice TV are violating both US State and Federal laws by using the name TV Guide.

According to the letter TV Guide has demanded that Google immediately terminate the Android application and the use of YP5 software which is used to develop the application.

According to documents seen by SmartHouse TV Guide has sent the same letter to 42 companies they say breach their trademark by developing a Google Application that uses the words TV Guide.

Colin O Brien the CEO of Ice TV said “.Google has now taken our IceTV Android app down and threatened us with further action. Just because we use the words TV Guide. TV Guide are either suffering from nationalistic megalomania, their legal counsel has lost the plot or they are deluding themselves as to how they can control the TV guides of the world”

 

A separate Google message to Foxtel and Ice TV says “Please note that notices concerning content in your app may result in action taken against any associated AdSense or AdMob accounts and repeated violations may result in a suspension of your Android Market Publisher account”.

A search by Smarthouse shows that the Foxtel TV Guide is still up on the Android Marketplace.

We have so far not got a comment from Foxtel.
