In an emergency hearing before Justice Robertson Samsung has sought an injunction to stop the sale of the new iPhone 4S in Australia claiming that it breaches Apple patents.
Justice Robertson ordered that the Cross-Claimants be granted leave to file by 6.00pm tonight Monday various sworn statements from several Samsung employees including, Wen-Ts’ai Lim, two affidavits of Rami Gabriel Mukhtar and an affidavit of Josue Delgado who is the Director of Telecommunications at Samsung Australia.
Samsung has told the Court that the iPhone 4S, released by Apple on Friday in Australia, infringes on three patents relating to various wireless telecommunication standards.
“In light of these violations, Samsung believes the sale of such Apple devices should be injuncted,” Samsung Australia said in a statement.
“Apple has continued to violate our patent rights and free-ride on our technology. We will steadfastly protect our intellectual property.”
Samsung has also announced on Monday that it was seeking an injunction on the sale of the iPhone 4, iPhone 4S and iPad2 in Japan.
