The previous case that Apple wants to access is believed to be the only occasion on which Samsung has previously taken a company to court over the patents that it is using to try to block the new iPhone 4S in Australia and Japan, according to ZDnet.
Samsung and Apple have been at loggerheads with Apple successfully having a temporary injunction imposed on sales of Samsung’s Galaxy Tab 10.1 tablet over alleged patent infringements, while Samsung has sought to have the same fate imposed on the new iPhone 4S.
On Friday in the Federal Court, Samsung was reluctant to provide the documents that Apple requested, claiming that previous litigation isn’t relevant to the current battle. However Justice Lindsay Foster ordered Samsung to provide the documents.
Samsung’s legal counsel told the court that it might take some time to dredge them up from storage.
